Violent Crimes Defense Attorney In Augusta
The pursuit and prosecution of violent crimes is a consistent priority for all prosecutors across Georgia and especially in Augusta. These crimes are always a draw for public attention, and can make a name for a prosecutor or show movement to the public. These are some of the reasons that prosecutors are so zealous in these cases, and that aggressiveness leads to mistakes.
My name is Pete Theodocion, and I’m a criminal defense lawyer for people in some of the most significant legal jeopardy imaginable. A violent crime charge is more than just a legal indictment, it’s a personal one and a professional one. It can carry consequences for every aspect of your life and your family. I can you defend against these difficult charges.
Experienced In Defending Violent Criminal Charges
As defense attorney for the last 25-plus years, and a background as a federal prosecutor, I have extensive time in and out of courtrooms on the most serious of charges. I have defended clients in such cases as:
- Murder/manslaughter
- Armed robbery
- Aggravated assault
- Kidnapping
- Sexual assault
- Attempted murder
- Terroristic threats
- Carjacking
- Home invasion
In each of these cases, whether it is at the state level or federal level the prosecution has the same job: compile evidence that proves guilt beyond a reasonable doubt. However, that job is not a simple one, and my ability to advocate for your rights, examine evidence and interview witnesses can punch holes in any case against you.
I work hard to help you find a plea deal or fight in court to get an exoneration. I’m not afraid to take any action you need to secure your freedom and protect your rights.
Violent Criminal Charges Are High Stakes
Violent charges carry some of the highest stakes imaginable under federal and Georgia law. In many cases, such as murder, the stakes aren’t just life imprisonment, with the death penalty listed as a statutory punishment.
The criminal punishments come with definite impacts to your personal reputation and professional life, and those do not even require a conviction to devastate you. Being even mentioned as a subject in some violent crimes, such as domestic violence or sex crimes, is enough to devastate your personal life.
As a part of your defense strategy, I can help you manage the legal consequences ahead of you, working to remove evidence and minimize charges. I can also help you confront these personal charges, providing advice and support you need to move through this difficult moment in your life. I will fight for you no matter the stakes.
How To Build An Effective Defense
Evidence is the key to any case, civil or criminal, that goes into a courtroom. Evidence must be accurate and compelling to the jury and the judge, and it’s my job to fight that evidence at the source. Part of my strategy will be to look at all the ways the case against you doesn’t meet the burden of proof. I do this by going after each aspect of the case, such as:
- Witness testimony: Eyewitnesses are notoriously unreliable, and there is considerable scientific evidence backing this up. However, they can also be extremely compelling and emotionally resonant. I depose and investigate each eyewitness, finding weaknesses in their story, and working hard to discredit their testimony.
- Physical evidence: A piece of physical evidence, such as DNA or fingerprints, are seen by most as the “gold standard” of evidence. However, collection methods and interpretation can color results immensely. Closely reviewing findings and aggressively interrogating the chain of evidence can often uncover key mistakes that make evidence inadmissible.
- Theory of the crime: At the heart of every prosecution’s case is the inherent “theory of the crime,” or the prosecution’s version of what “really” happened. A theory of the crime can be faulted at the evidentiary stage or the witness stage, or simply the logic of the theory. Calling into question motive or location or providing alibis all undermine the prosecution’s case.
As a former prosecutor, my insight into how cases are built against defendants is invaluable when building an effective defense strategy.
